Terms of Service

1. Acceptance of Terms

By accessing or using SupCMMS ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and organizations that access or use the Service.

2. Description of Service

SupCMMS is a cloud-based Computerized Maintenance Management System (CMMS) that allows organizations to manage work orders, assets, preventive maintenance, inventory, and maintenance teams. The Service is provided on a subscription basis with a free Freemium tier and paid plans.

3. Account Registration

To use the Service, you must register for an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and must promptly notify us of any unauthorized use of your account. We are not liable for any loss arising from your failure to keep your credentials secure.

Organizations ("tenants") may invite additional users. The tenant admin is responsible for all activity occurring under their organization's account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Upload malicious code, viruses, or any software intended to disrupt the Service.
  • Use automated means (bots, scrapers) to access the Service without our express written permission.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Resell or sublicense access to the Service without our prior written consent.

5. Subscription Plans and Billing

SupCMMS offers a free Freemium plan and paid plans (Small Team, Large Team, Unlimited). Paid plans are billed monthly through Paddle, our Merchant of Record payment processor. By subscribing to a paid plan you also agree to Paddle's terms and conditions, which govern payment, invoicing, and tax handling.

New paid plan registrations receive a 14-day free trial. No credit card is required to start the trial. After the trial ends, your account will automatically downgrade to the Freemium plan unless a payment method has been added.

We reserve the right to change pricing at any time with at least 30 days' notice to existing subscribers. Continued use of a paid plan after a price change takes effect constitutes acceptance of the new pricing. Billing matters, cancellations, and refund eligibility are further described in our Refund Policy.

6. Free Tier and Freemium Limitations

The Freemium plan is free to use but is subject to usage limits — including the number of work orders, assets, and users — as described on our pricing page and within the app. We may modify these limits with reasonable notice.

If your usage exceeds a Freemium limit, further actions in the affected area may be blocked until you upgrade to a paid plan or reduce your usage. Optional Freemium add-ons (Preventive Maintenance, Inventory) are sold as separate monthly subscriptions.

7. Data Ownership

You retain full ownership of all data you upload or create within the Service ("Customer Data"). We do not claim any intellectual property rights over your Customer Data.

You grant us a limited, non-exclusive, worldwide license to store, process, transmit, and display your Customer Data solely for the purpose of providing the Service to you. Our handling of Customer Data is further described in our Privacy Policy.

8. Service Availability and Modifications

We aim to provide high availability but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue the Service (or any feature thereof) at any time with reasonable notice.

We may perform scheduled maintenance that temporarily affects availability. We will endeavor to conduct maintenance during off-peak hours.

9. Intellectual Property

The Service, including its design, code, trademarks, and content (excluding Customer Data), is owned by SupCMMS and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or proprietary materials.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPCMMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, REVENUE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless SupCMMS, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your use or misuse of the Service, (b) your violation of these Terms, or (c) any third-party claim arising from content or data you upload, create, or share through the Service.

13. Termination

You may terminate your account at any time by contacting us or by using the self-service deletion flow in your organization settings. We may suspend or terminate your account if you violate these Terms or engage in conduct we reasonably consider harmful to the Service or to other users.

Upon termination, your Customer Data will be deleted within 30 days, except where retention is required by law. Provisions of these Terms that by their nature should survive termination — including Sections 7 (Data Ownership), 9 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) — will remain in effect.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Serbia.

15. Changes to These Terms

We reserve the right to update these Terms at any time. We will provide at least 14 days' notice before material changes take effect by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance.
